General Terms and Conditions of Purchase

These General Terms and Conditions (hereinafter, "General Conditions") establish the terms and conditions that govern the commercial relationship between Explotacions Turistiques Bintur SL and the user or client for contracts made through the website. https://ponentcalaratjada.com 

By making a reservation through the website owned by Explotacions Turistiques Bintur SL, the client or user of the website expressly accepts these conditions, as well as the conditions of use established for browsing the websites of Explotacions Turistiques Bintur SL.

These conditions are applicable in conjunction with the corresponding legal regulations applicable in each case. The General Terms and Conditions regulate the distance selling relationship between Explotacions Turistiques Bintur SL and the user or customer, in accordance with the legal provisions, including, among others:

• Law 7/1998 of 13 April 1998 on General Terms and Conditions.
• Law 3/2014, of 27 March, which regulates the distance selling relationship between Explotacions Turistiques Bintur SL and the user or customer.
• General Law for the Defence of Consumers and Users.

• Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

 Explotacions Turistiques Bintur SL reserves the right to make any modifications it deems necessary to the General Conditions without prior notice. These modifications may be made through its websites and shall be binding as long as they are published on the website, until they are validly modified by subsequent changes. However, Explotacions Turistiques Bintur SL reserves the right to apply Specific Contractual Conditions in certain cases, announcing them in a timely manner.

All website content is available in English, Spanish and German.

Pre-booking Information

Before making a booking, Explotacions Turistiques Bintur SL provides detailed information about the booking procedure on its website. Users are also informed that the terms of use are available on the website. By booking with Explotacions Turistiques Bintur SL through its website, the user or client expressly declares to know, understand and accept these terms of use and the General Conditions.

Furthermore, the user declares to be of legal age and to have the legal capacity to access the websites of Explotacions Turistiques Bintur SL and to contract through them. The user is responsible for maintaining the identity and password obtained when registering as a client in a confidential and responsible manner, and must not share them with third parties. Once the booking has been made, the user will see the confirmation of their booking on the screen and will be able to print it as proof of the booking made.

Additional Conditions and Services

The client must always inform Explotacions Turistiques Bintur SL of the number of guests that will be staying in the accommodation. The maximum number of occupants must not exceed the number indicated on the booking confirmation. Increasing the number of occupants without prior authorisation may result in the cancellation of the contract and does not entitle the client to claim or request a refund of the rental amount. Any incident affecting the habitability of the property must be reported immediately when detected. No claims will be accepted for incidents that have not been reported during the stay.

Explotacions Turistiques Bintur SL ensures that the properties are delivered clean and with bed linen and towels suitable for use. For bookings of more than 7 nights, an additional amount of clean bed linen and towels will be provided, which are included in the price. All persons responsible for the maintenance of the property and its facilities will have authorised access to carry out maintenance work necessary for the guests' stay, even if they are not present. Check-in time is at 16:00 p.m., and check-out time is at 10:00 a.m. However, with prior consultation and authorisation from Explotacions Turistiques Bintur SL, the client may enter or leave the property at a different time. If the client checks in after 24:00 p.m., there may be an additional cost of FIFTY EUROS (50 €), at the discretion of Explotacions Turistiques Bintur SL, to be paid by the client at the time of entering the property. 

How Booking Works: Booking, Bidding and Price References

Explotacions Turistiques Bintur SL provides information on all possible reservations, their characteristics and prices on its website, in compliance with Law 34/2002 on information society services and electronic commerce. The availability of offers may vary according to customer demand. Although Explotacions Turistiques Bintur SL updates its database periodically, it is possible that the requested reservation is not available at the time of the request. In such a case, Explotacions Turistiques Bintur SL will send an e-mail to the customer informing him/her that the requested reservation cannot be confirmed.

The prices indicated on the website will be those in force at any given time, except in the case of typographical errors. If there is a price difference due to typographical errors, Explotacions Turistiques Bintur SL will inform the customer by e-mail before charging the booking. Special offers and promotions will be clearly marked as such.

Sustainable Tourism Tax in Mallorca 

In Mallorca, there is a Sustainable Tourism Tax, also known as "Ecotasa" or tourist tax. Guests over 16 years of age are obliged to pay this tax. The price of the Ecotasa is €2.20 per night and €1.10 from the ninth night onwards (prices include VAT) for stays from May to October. From November to April, a discount of 75% applies.

Payment Methods and Service Execution

Explotacions Turistiques Bintur SL offers the possibility to pay for bookings using a secure online payment system. Payment is made securely directly from your credit/debit card, bank account or other available means to Explotacions Turistiques Bintur SL's account via a third party provider, Stripe. Payment must be made in euros, and any currency exchange charges and bank charges related to the payment are the responsibility of the customer.

 The payment schedule for reservations is as follows:

1. Reservations more than 30 days in advance:
   1. Booking date: payment of 15% of the total amount of the booking.
   2. 30 days before the arrival date: payment of the remaining 85%.

1. Reservations 30 days or less in advance:
   1. Booking date: payment of 100% of the booking amount.
   2. Failure to comply with the payment schedule may result in the cancellation of the booking and the loss of the deposit. Validation of the service will be considered effective once Explotacions Turistiques Bintur SL receives the payment confirmation from Stripe.

Cancellation and Modification of the Reservation

In case of cancellation by the customer, a cancellation fee will be applied according to the following breakdown:

1. Cancellations made more than 90 days in advance: free of charge + refund of deposit*. The customer will be responsible for bank charges.
2. Cancellations between 30 and 90 days prior to arrival: 15% of the booking amount equivalent to the deposit paid by the customer to confirm the booking.
3.  Cancellations within 30 days prior to arrival: 100% of the amount of the reservation.

Any total or partial change of the reservation may be subject to variable modification fees. Changes before the date of arrival will be subject to availability and subsequent confirmation by Explotacions Turistiques Bintur SL. If the client leaves the property before the end date of the contract, no refund of the amount paid will be made.

Right of withdrawal!

In accordance with the provisions of article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, the right of withdrawal does not apply to the provision of services or goods made according to consumer specifications or clearly personalised, or which, by their nature, cannot be returned or which may deteriorate or expire rapidly. Reservations are therefore excluded from the right of withdrawal.

Data Protection

In accordance with the provisions of current legislation on Personal Data Protection, you are hereby informed that your data will be incorporated into the processing system of Explotacions Turistiques Bintur SL with NIF B72814585 and registered office at Via Mallorca 8, 07590 Cala Ratjada - Illes Balears, in order to facilitate, expedite and fulfil the commitments established between the two parties. 

In compliance with current legislation, Explotacions Turistiques Bintur SL informs that the data will be kept for the period strictly necessary to comply with the aforementioned precepts.

We inform you that the processing of your data is legitimised by your consent and/or the contractual relationship that we have with you. Explotacions Turistiques Bintur SL informs that it will proceed to process the data in a lawful, loyal, transparent, adequate, relevant, limited, accurate and up-to-date manner. Therefore, Explotacions Turistiques Bintur SL undertakes to take all reasonable measures to ensure that they are deleted or rectified without delay when they are inaccurate. In accordance with the rights conferred by current legislation on data protection, you may exercise your rights of access, rectification, limitation of processing, deletion, portability and opposition to the processing of your personal data, as well as the consent granted for the processing thereof, by sending your request to the postal address indicated above or to the e-mail address hola@ponentcalaratjada.com.

You may contact the competent supervisory authority to lodge a complaint.

Applicable Law and Jurisdiction

Furthermore, Explotacions Turistiques Bintur SL reserves the right to take any civil or criminal action it deems appropriate for improper use of its website and content or for breach of these conditions. The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. In the event of a dispute, the parties may submit their disputes to arbitration or go to ordinary jurisdiction, in accordance with the corresponding rules of competence and jurisdiction.
